1. Accuracy of Information: You are solely responsible for providing accurate, current, and complete information required for the tax filing services. CMTax KE is not liable for any penalties, interest, or additional taxes arising from incorrect or incomplete information supplied by you.
2. Service Fees: Applicable service fees are displayed on our platform at the time of application and are subject to change. Fees are non-refundable once our team has commenced processing your application, which may include accessing KRA systems or beginning data entry on your behalf.
3. Processing Time: We strive to process applications efficiently, typically within 3-5 business days. However, this is an estimate and may be affected by factors such as KRA system availability, the complexity of your tax situation, and the timely provision of all required information by you.
4. Scope of Service: Our services are limited to the preparation and submission of tax returns and related filings as described for each service package, based on the information you provide. We do not offer comprehensive tax advisory, financial planning, or legal consultation unless explicitly stated as part of a premium service offering.

2. Data Authorization and Confidentiality

• Authorization: By using our Service, you grant CMTax KE and its authorized personnel explicit permission to act as your tax agent. This includes accessing your KRA iTax profile (if credentials are provided by you) for the purpose of preparing, reviewing, and filing tax returns and related statutory documents on your behalf.
• Confidentiality: We are committed to protecting the confidentiality and security of your personal and financial information. All data provided will be handled in accordance with our Privacy Policy and relevant data protection laws in Kenya. Your information will only be used for the explicit purpose of delivering the requested tax services.
• Data Security: We implement reasonable and appropriate technical and organizational security measures to protect your data against unauthorized access, disclosure, alteration, or destruction. However, please note that no method of transmission over the Internet or electronic storage is 100% secure.

3. KRA iTax Password Policy

• Credential Provision: If you opt to provide your KRA iTax password, you acknowledge that this grants us temporary and limited access to your iTax profile. This access is strictly for the purpose of fulfilling the specific tax service you have engaged us for.
• Your Responsibility: It is your critical responsibility to change your KRA iTax password immediately upon receiving confirmation from us that the requested service has been completed. This is a vital step to ensure the ongoing security of your iTax account.
• Limitation of Liability (Password): CMTax KE shall not be held liable for any unauthorized access, data breaches, financial loss, or any other issues arising from your KRA iTax account if you fail to change your password promptly after service completion, or if your credentials were compromised through other means not attributable to our direct negligence.
• Password Security: We strongly advise using a unique, complex password for your KRA iTax account and enabling any multi-factor authentication (MFA) options provided by KRA. Do not share your iTax password with unauthorized parties.

4. Limitation of Liability

• To the maximum extent permitted by applicable law, CMTax KE's total liability arising out of or in connection with the Service, whether in contract, tort (including negligence), or otherwise, shall be limited to the amount of the service fee paid by you for the specific transaction giving rise to the claim.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
• We are not responsible for errors, omissions, or actions taken by the Kenya Revenue Authority (KRA) or any other government agency.

5. Amendments to Terms

• We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least thirty (30) days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
• By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

6. Governing Law

• These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
